
CreaGUARD
Date of publication:Before the adoption of the European Directive 2019/790, most creative works were used without the authorization of their creators. A process identifying the genuine creator through CreaBOOKs has been defined by the Universal Standard of Intellectual Property (USIP). The present document determines how CreaGUARDs help creators using the CreaBOOK may spread the moral right of creators to impose the ecological exploitation of their creative works. According to this process, participants in the CreaFREE Ecosystem become CreaGUARDs of the CreaFREE Ecosystem. As such, they may take the initiative of drafting CreaBOOKs documenting ownerless creations and promoting the author-right to require their ecological exploitation. The CreaGUARDs then identify the creator/right-holder, transfer her/him the rights attached to this CreaBOOK by international intellectual property law, and receive a share of the royalties attached to the creations. Altogether CreaGUARDs contribute to the building of an Ecological Encyclopedia of Creations. In this global Encyclopedia, creators not only describe and claim the property of their artistic, literary, and scientific production. But also accept the responsibility of their creative works and take the necessary measures assuring their good ecological use.
